Usually, when someone can take over a domain name, it is because the domain has become available through inactivity (not the case here) or because the domain holder has forgotten to renew. I would bet that eBay forgot to send in the check for their .de domain or did, but forgot to list it out on the payment. Then you blame the accountants for not doing their jobs.

If it came up as transferrable, then the kid was unethical to take advantage, but wasn't necessarily out to steal.

As for stumbling onto the sites, it is not outside the realm of possibility to hit that kind of information just using a "Feeling Lucky" Google search and the keyword "website".

They refer to him as a "school pupil." At 19, a person still in school is attending the equivalent of Junior College and had to test high to get there (at least that was the case when I lived in Germany). Otherwise, he would be working or doing his mandatory military service. So I do doubt the "computer illiteracy" part of his story.
