an appliance is not a witness
It is very interesting that in the corporate world we have CEOs and other high-ups looting companies and getting away with it (or at least getting away with plenty of cash) while employees at the bottom of the pecking order can have their lives ruined by what someone "finds" on their PC. Unless employees organize and become politically active as advocates of their own self-interest we can only expect more of the same.

It is worse than idiotic to think that individuals have any bargaining power whatsoever when trying to stand up to a large corporation. It is also idiotic to believe that if you have done nothing wrong you have nothing to worry about. Your PC at work is an appliance that you MUST use or you would not have a job. It is located in a public place where plenty of other people can access it directly or even electronically 24 hours a day. Its security is non-existant as anyone who has followed the saga of "Microsoft patches" can attest.

As a very first step, the courts should immediately throw out any/all cases that are based purely on PC "finds." The posts here reveal that hackers (and co-worker IT types with an agenda) can plant whatever they want on any PC they target.
