It depends on where you live..
In the US, downloading is probably illegal.. esp. if you have a substantial "collection", you could be prosecuted under the NET act (why they call it "electronic theft" is beyond me.. ).

In Canada, where we pay a levy for blank media such as CD-Rs, downloading is legal. Leaving songs in a shared folder where others can download them from is also legal. However, from reading the court decision, uploading itself is illegal.. so, IMO, P2P applications like eMule or BitTorrent are illegal to download copyrighted works.
