Exactly--That's the problem
"Probably" is the appropriate word. We don't know. It's never
been tested in a court of law. In theory, it could be illegal. The
RIAA has done everything within its power to 1) make everyone
think it's illegal, and 2) keep any sort of ruling very far away
from the courts, so it can never be proven one way or the other.

But I think it's premature to say that downloading is perfectly
legal. It may be, it may not be, and you stand a much smaller
chance of ever getting identified, but that's as far as I'd go.
