the article is using the premise that the downloader is technically making a copy of the work on his own computer... i think that's a slippery argument since it really depends on how you interpret when a "copy" is made in the digital world... but nothing even close to it has set a prescedent right?

as for the last statement you made: while others download it from you? already means you are distributing the work and not soley downloading it.

he basically has something that an interpretation and may or may not hold depending on the courts, then he backs it up with a statement that isn't directly and exclusively supporting his first theory...
