Spyware will always be with us
Nowadays it seems like there is no greater villian than the person who tells an inconvenient truth. The fact is, any law that realistically can be expected to stop spyware will also cripple the web. The best we can hope for is something like what Dan is proposing. That is to say, a user-friendly mechanism where you can find out what data you are giving up, and what limits you would have to put on your surfing to stop that from happening.

That wouldn't be an ideal situation, but it would sure be better than what we have now, where my new HP machine seems to be periodically crippled by outgoing data bursts that have no apparent purpose.
