Hacking the protocol vs. implementing a new one
I'm sure if DVD Jon had found a way to upload a new protocol into the firmware this would be a non-issue, and would be similar to someone running Linux on an XBox. Because once someone owns the hardware, there's really nothing you can do to stop them from using it any way they see fit.

But by not touching the firmware and reverse engineering the proprietary protocol, that's a bit different. It's not quite the same as Samba reverse engineering the SMB stack because that is an open protocol that MS just happens to use. I guess the question is whether a protocol can be copyrighted or patented. And I honestly don't know the answer to that. In fact it may have a different answer depending on which country you live in.
