What he is getting in trouble for:
1) adding the backdoor. Whether he uses the backdoor is immaterial. He has violated the privacy of someones machine. Actions have consequences.

2) The act of distributing a virus or worm regardless of payload (destructive or not) is in itself vandalism and can cost organizations tens of thousands of dollars and individual users much time and effort. Not to mention stealing network bandwidth. Actions have consequences.

3) Both 1 & 2 in addition to doing damage are violations of existing laws. Again actions have consequences. Don't want the consequences don't do the actions.
