The next step for them is to go after US based ISPs and search engines to get his site blocked.

This has happened before: recall the Thai site with a single Gary Larson far side comic strip on it, some agent claiming to represent Larson required Google remove the site from its searches using a DMCA claim.

Recall also MPAA vs 2600 preventing magazine 2600 linking to the DeCSS DVD decoder code.
In the latter case they found that linking to the DeCSS code was the same as distributing it.

Since US ISPs have no gain in protecting Italian free speech, and since they could be made liable if they don't block, they will probably just cave and block. No judge will review it since there is no opposition, so again we have this same problem with the DMCA.

Yet another reason to ditch the DMCA.
