You have to take care how literally you take the presumption of innocence. If you took that to the ultimate degree, the police would never be able to arrest, no matter what.

As a Canadian judge stated when dealing with just that supposition "The presumption of innocence starts at the courthouse door. The police must make a presumption of guilt, else they would never be able arrest"

Different jurisdiction, same principle.

I would be interested as to WHERE the vehicle was when MPs put the tracker on, and where the car was when they recovered it.

Personally, I see no difference between tracking electronically, and putting a tail on someone. And the "open field" concept shows that sometimes the judiciary uses common sense.
