Is it legal for private citizens to place tracers?
If it is, it should be legal for the police to do the same. If not, it should require a warrant (I think that's a much more plausible rule than "expectation of privacy". I'm not a big fan of the exclusionary rule, but unless we're willing to hold police officers and government officials personally responsible (and liable) for "unreasonable searches" it's really the only effective enforcement mechanism for the 4th Amendment there is.
