I think the judge's observation about laws not keeping up with the implementation
of computer technology (code) is correct.
the observation about the current corporation "model" and the way that it impacts
society is also correct.
As to Public and Private:
someone posted:
"Sure the internet is open and public. But there are other places that are open and
public, like the shopping malls. Would people allow the same invaasion of privacy
while they shop in a mall as happens while they are on the internet? "
Actually I think you "mall shopping" activities are being monitored on the mall's
security cameras.
What has changed in the last few years is the effectiveness of data mining
algorithms and the ability of software and hardware to crunch massive amounts of
data at light speed.
coupled with adequate traffic monitoring -- You can be monitored right now as
you load and read this message. So too your Email can be read, unless you have
encrypted it.
I think there is also a strange phenomenon taking place all around us in this milieu
of the internet --- people do things and perhaps say things on the net they would
never have done (or said) anywhere else.
For example, I really can't see a couple going down to the local pub and taking
their clothes off and going down on each other on a table top in front of everyone,
and yet, xtube is a growing website.
And have you noticed that xTube came along a few years after "Blogmania"? Is
there a trend?
There is also a plan for your neighbors to put videos of you as "news" items on a
new proposed "Public news by the Public" website.
Notice I didn't ask is this IT usage good or bad, I am only saying that it exists. An
interesting sociological phenomenon.
One thing that was not mentioned in the responses was the use of data mining by
government "agencies" -- which in my opinion is a violation of the individual's
privacy. Notice that I am not referring to "court authorized" wiretaps, just data
mining of all data available on an individual, or possibly monitoring your online
activity.
