Bulk Automated Montitoring is dificult on Emule
Especially if people keep their IP blocks up to date. Some people even install peergaurdian for a global block on their computer. It is difficult to bulk montitor Emule clients whehter your the FBI, the Police, RIAA, a spammer, or a marketing research bot. Doesn't mean that an FBI agent can jump on a personal connection and monitor manually. IP blocking Doesn't work much on individual tracking, just bulk monitoring that carnivore was meant to do. Emule sends very few things plaintext so even sniffing would be limited effectiveness unless it was programmmed to deal with the packet compression.
