Suing the wrong people
Suing the guy paid to send spam is like going after the guy buying drugs from drug dealers. You have to cut off the problem at its source. That being the advertisers who pay to send Spam. Nail them and you have fewer and fewer willing to pay fees to spam.

Going after a Spammer is nothing. Kill one and another takes his place. It can't be helped with this money sitting there for the taking. Remove the incentive(money) and you fix the problem.
