While you are correct about how the law currently works, they were still breaking copyright law by trying to sell the source code. In addition there is the question of how they acquired the code. If it was by disassembling it that's one thing. But if they got it by hacking into company systems then they DID steal it because it was acquired by illegal access to systems which is a crime.
