The problem is that in today's society, a slap on the wrist fixes nothing. Thieves, murderers, and the like realize that our "civilized" legal system will hand out a "fair and just" (read no) punishment. Life in prison raises my taxes. Rehabilitation raises my taxes. The fee for a "public defender" raises my taxes. This goes to show that there is more than one victim for this "mild criminal activity".
