I don't know about the US
But in Canada it doesn't matter if you and government agent or not. citizens can not illegal seize or search. That sounds like big loop hole in your justice system if that is not in your constitution. After all a police officer is a private citizen when off duty so they could very well search and seize freely then or get family and friend to do it for them.
