RE: Canada to criminalize identity theft
I must respectfully disagree with Aaron on the issue of sentencing.

His attitude seems to be "throw away the keys" - but that unsophisticated approach to criminal justice has been repeatedly shown to be a failure in that it does not contribute towards either greater safety or lower rates of crime.

Similarly the suggestion by another writer (not Mr. Baker) that identity theft have a "minimum" 10 year sentence is not grounded in reality. Minimum sentences are rarely used anymore in the Canadian justice system (there are still a few exceptions - murder, for instance has a minimum sentence of LIFE) due to the fact that such sentences fail to take into account the many mitigating circumstances which may accompany a particular offence or offender.

As a Canadian, I am proud that our courts have advanced beyond the "throw away the key" mentality - some of our US counterparts still seem to be of the view that ever-harsher sentencing is the answer to crime deterrence - but the evidence seems to suggest that building more jails is not going to work.
