It's civil law - not common sense.
Dude its called civil law, my computer is my property and I decide what can and what can not be installed on it. No software has the right to make that decision for me. It is a general principle of any civilization, I'm the one who has the last say about what can be done on my property and what not.

This is a big victory in the battle against spyware and you are concerned about the ruling being based on common sense? You're missing the point here.
