They call that stuff 'adware'
Most anti-spyware vendors have a subcategory called 'adware' or 'ad-supported software' which indicates that the software may serve a purpose that justifies the display of advertising. The user is then asked to make a decision regarding whether he/she is OK with that tradeoff. Generally speaking, for a program to be classified this way it must behave itself in other ways; i.e. no pop-up ads, no efforts to impede removal, no attempts to obfuscate itself through deceptive naming or specious warnings, and so forth. This is the model I think you're talking about here (or at least the Web analogue.)

The "adware" category is the best example of how the anti-spyware vendors are seeking to provide information only and allow the user to make the decision. Examples of this category are Weatherbug and Dealio. Different companies might classify them differently, but those are their own decisions.
