RE: A turn in the antispyware war?
"The danger of the Zango suit and others like it is that deep-pocketed adware distributors"

Being a major antivirus vendor, Kaspersky is hardly shallow pocketed themselves. They can afford a good battle.

"If we are going to continue to win the battle against spyware, legislators and the courts must continue to defend a robust, competitive marketplace for user empowerment tools."

Agreed.

Here's a link to the court case I think ZDNet is referring to:

http://news.justia.com/cases/390833/

Really, though, ZDNet should've provided a link in their article.

"Do not have to follow a 'good faith' standard when labeling software objectionable"

If I'm reading the court documents right, I think the whole "good faith" deal had more to do with whether Zango was giving Kaspersky enough time to address incompatibilities with their software. Which in the end didn't really matter, because Kaspersky pointed out that they are under no obligations to ensure compatibility with their software, and that addressing compatibility problems was a nice thing to do, but not legally required.

And oh, yeah - Zango has, of course, appealed.
