Most reputable anti-spyware software publishers (especially those in the AntiSpyware Coalition) have readily accessible methods for reporting and examining false positive reports. However, realize that each company is free to call any software package that it examines whatever it wants. Anti-spyware programs are there to provide information, not put anyone out of business. Most of them will let you choose to allow something to run that they have identified as spyware.

If there are companies that are worried about being put out of business by being identified as spyware publishers, then they should probably look at their practices to determine what behavior of their software led the company to identify them in the first place. If the software provides a useful service, then people won't remove it. Their customers have expressed a desire to be able to easily identify and remove software that they don't want on their computer. The customer is trusting the anti-spyware software publisher to make good decisions regarding classification, and if they don't like the way things are classified, they can uninstall the anti-spyware program, or use a different one. Nobody is holding a gun to their heads and saying "OMG YOU MUST REMOVE THIS!" (Whether or not a naive user takes a warning to mean that is beyond their control.)
