WTF? Completely different.
Standard journalistic practice is to sumarize the information needed to understand the article before moving on to the analysis. That's why every article about Britney losing custody of her kids lists all her previous troubles ad nauseaum.

This article on the other hand started right off telling us what a good ruling this was and what it allowed anti-spyware vendors to do. The only problem is I don't know what the suit was about. There was no summary of that at all. Do I agree with the article or not? I've got no way to tell as you've never told me what the ruling pertained to.

Someone needs to go back to writing school.
