All of these devices are tested before use. They have very strict QA and range of analysis tests.
Yes they get people drunk to test breathalysers. Sound like your dream job?
Just like we have to do testing and calibration on any device you are relying on for an accurate reading. The source code should only come into play at initial acceptance by the users (police) unless there is a software patch applied to the devices at some point.
Asking for the source and expecting not to get it and be able to throw out the case is the only reason a defendant would want to ask for it.
If the devices are within their calibration schedule there should be no reason to look at the source. Unless there was some reason to think there was a way for the police/prosecution to effect the outcome of the system?

Now voting machines, can't be calibrated. But they do allow cheating.
