The installation of any program on an individuals machine without that persons consent (direct or indirect) should be illegal.

Hasn't microsoft been prosecuted for bundling IE, Windows Media Player, and Microsoft Java CM on windows machines without consent?

And not all 'viruses' have malicious or damaging intent. Remember the White Hat version of MS-Blast? The one that actually went and patched your machine? Well they're still seeking prosecution of the individuals involved with that. If those individuals, who actually were 'tidying up the kitchen', are found and can be prosectuted, then these individuals, who are 'breaking in to the kitchen' and just throwing advertising all over it (no, they are not tidying it up, they're cluttering it up) should be shot.

Adware, spam, and spyware should be completely outlawed, regardless of the installation methods involved.

And don't get started on "adware supported software". A lot (not all, but most) of it is crap, or freeware is available that performs the same function (and does it much better).

Heck, theres even a spyware scanner which is nothing more than a trojan horse for spyware and adware. Talk about evil!

And don't point your finger at microsoft flaws! There is not one 100% secure operating system or program out there. The only reason Microsoft gets hit is because THATS WHAT THE MAJORITY OF PEOPLE USE. If Linux, Mac OS, UNIX, or OS2 had the same installed user base as Microsoft, then we would be complaining about them.

Until Adware, Spyware, and Spam are outlawed, with real penalties to the creators and the web sites and companies that pay the creators, we will continue to see it. (I think a good penalty would be forced gender change, followed by a full frontal lobotomy and six months of daily electroshock therapy, followed by forfeiture of all real assets or a combination of any three.)

And if you are one of those folks profiting from adware and spyware (and judging from some of the responses, some of you are) then :

may the bird of paradise fly up your nose,
may an elephant caress you with its toes,
may your wife be plagued with runners up her hose,
may the bird of paradise fly up your nose.

(I can see some of the replies now "I have to use adware to support my DominaMatrix 3 screensaver program, those things dont write themselves you know." If your DominaMatrix 3 screensaver's that good, people will pay you for it. And believe me, its not that good, and shouldn't have taken more than 20 minutes to create.)

(If there really is a DominaMatrix 3 screensaver, which is not supported by adware, I apologize, I tried to make up a fictitous name. I didnt find DominaMatrix 3 on google.)
