Let me get this straight...
He wrote this code and posted it for download. He didn't actually release it into the wild as a virus, just posted the program which someone else deployed, so he's arrested.

So called security experts post sample code demonstrating how to exploit flaws in an OS and they're regarded as good guys.

Granted the intent may have been somewhat different but the results are very similar...
