You forgot about one thing........
People are stupid! And juries are made up of people.

I recall the story of a lawnmower manufacturer. Note the name
of the product......Lawn Mower. It kinda implies that one would
mow ones lawn. They were sued (sucessfully) by some idiot that
used it as a hedge trimmer and cut of some body parts after
dropping it.

Several Million $$$ later and a new warning sticker, "not to be
used as a hedge trimmer".

I'd like to see large parts of the EULA done away with. I just see
massive a mounts of law suits from idiots that lose data just
because they didn't save thier work during a thunderstorm and
the power goes out.
