Well, there are all the laws the MPAA and RIAA continuously break, not to mention the contracts they regularly violate. I guess TorrentSpy was holding themselves to a higher standard, and weren't willing to break the contract (terms of service) they'd signed with their users.
Should be interesting to see if it holds up in court as it is pretty unprecedented, asking a company to create new records after a case has been filed and hand them over to someone who is suing them.
