Microsoft won't crack down on that
Microsoft won't crack down on that, not the users anyways. The most they will do is crack down on the vendor. If they start going after users on whether they're "students" or not, they'll quickly make a lot of enemies out of CUSTOMERS. Microsoft isn't stupid. This is why you will never see Microsoft cracking down on students or poor third world country people that use illegal copies of MS Software. It would be a PR disaster and they'll just drive poor users to Open Source alternatives which is the last thing they want to do. The only customers they will crack down on and sue are businesses that illegally use copies.
