But I don't believe anyone has died or been injured from using software. (Unless you count the bruises on the hand from pounding on the computer)

Yes they should be held liable, just like any other company. That would probably lead to a dramatic improvement in the software funtion. Let's face it, if responsibility is not there then neither will quality.
