"We would hope that there could be laws that would prohibit the posting of malicious code," Kuo said. "Sasser was partially written by some malicious code that was downloaded by the Internet."

Laws don't stop the big guys. Exactly what and who defines something as malicious code? I got a script that deletes certain files when run. Is that a bad thing? The way I see it, all you would be doing is adding legal costs to the current problem. Lets not forget the whole freedom of speech thing.

IMO, give the kid a few hundred hours of community service and a night or two in jail. Then let him go about his life. This virus wasn't that big. Plus, he didn't exactly personally go and break into every computer and infect it... other people's infected computers did that. The media is hyping it up because it's the first major successful arrest by the authorities.

These types of things are just risks and costs that come with using the tool. It's dependent on what OS you use, if you are connected to the net, and what your patch/security model is. You made you choices, so take the necessary precautions, and move on with your life.
