One unanswered question...
Can someone please explain why this Hoffman fellow is not already in jail when he has publicly released the following information:

1) He's written a tool with (according to this article) purely malicious intent
2) He intends to use that tool for malicious purposes himself
3) He is going to distribute this tool to hundreds of thousands of people that he knows will also use it for malicious intent?

Is ZDNet offering this guy some kind of immunity, or what? This is more concerning to me than the tool itself.
