It can, and does happen
Until users can get all the firmware info for products, there is little way to find rootkit problems by any type of 'scanning'. So,
what does that leave us? How about nothing, but a Low Level Format? Manufacturers never care about the work, or losses they may cause to people so long as they 'think' they only need to protect their own monetary interest. Proprietary property? If that is a true and real scenario, then they should be paying the original discoverers of the entire system of their field. ie: Pay royalties to the families of people such as Leonardo DaVince' for inventing the system of automatically igniting gunpowder by the mere pull of a trigger, thereby providing the method and incentives to further it all the way to our modern time weapons. Now, that example is true 'proprietary' ownership.
