I wonder if the IT controllers concerned will be prosecuted for failing in their duty to protect their system and would they get the same treatment?
If you leave a book open then it is likely that someone will try reading it.
If you don't want it read then you have to protect it. Imagine a bank that failed to protect its data. Would you expect no-one to read that data? And whose fault would it be?
The US Government want too many powers to punish others when the first and greater failure is theirs. They are guilty of aiding and abetting this crime. Perhaps the UK courts could claim that this is a malicious prosecution to protect the guilty ones in the US. The trouble is that Tony Blair is so far up the nether regions of George Bush that it would not be allowed to happen until after he has left office and is replaced by a less compliant toady!
The US does not play on a level playing field!
