Location, location, location...
It's the location of the crime that determines jurisdiction, not the citizenship or nationality of the alleged perpetrator. Your argument reminds me of the reaction of the IBM executives trying to comprehend terminals. Before then, you punched cards, submitted them to the creatures in the machine room, and waited for the results. When the people who were trying to create terminal-based real-time applications for computers were making their pitch, it took several hours of explaining before one of the managers said to another, "Oh! They want to move the machine room out of the machine room!" They simply couldn't comprehend how you could access the computer without being in the same physical location as that computer. Now that is how EVERYONE accesses shared computers.

If he had used a telephone to call in a bomb threat from his home in London to anyplace in America, for example, he would still be liable under American law, because that's where the actual perceived threat took place. Likewise, the computers were located in American territory. Access to them is governed by American laws. It doesn't matter if I'm an American citizen or a British citizen: my use of these computers is governed by American laws. If you hack into a computer located in German territory, you will be subject to German laws, and you would be subject to extradition to Germany to stand trial.
