Your reaction is so typical of people who never stop to actually think about the way the law works and why it has to work that way, you simply say lets throw the guilty in jail. First off, in a case of piracy such as this, there would have to be a rational method of drawing the line on who goes to jail and who dosnt. Unless you are saying that even Joe Blow your buddy down the road who sold a bootleg copy of something to someone is going to go to jail just like every pirate should.
Secondly we are generally/usually talking about a crime in a case like this that really only results in pecuniary damages. Your suggestion about jailing the culprit may well be the last thing that a company like Symantec wants, they don't want a civil lawsuit plaintiff in jail they want the jackass at work earning money they can get off of them.
Next, who all in the company is going to jail? Of course the guy in charge who ordered up the piracy in the first place, but who else? You cant run an operation that keeps over a hundred thousand copies of the software in stock and makes millions of dollars all by yourself. Who knew what and who did what? If your going to throw people in jail because of this, a democratic justice system is going to demand a lot of resources and time from the legal system and the public has got to pay for criminal trials, unlike civil trials that rely on the resources of the plaintiff who brings the claim and the defendant who either gives in or pays out of his own pocket to defend against the claim.
Why in the world anyone would want to see someone end up in jail over something like this baffles me. Its not going to stop piracy if you start filling jails with pirates and its often going to interfere terribly with the ability of the infringed party to recover their lost revenue.
