Linux has the same problem ... sort of ...
Linux laps hibernate and thus have the same vulnerability. As long as the thief stole the lap in hibernation and made sure not to allow it to shut down, he's got the data and the protection is useless. So it would be crucial for the employee to make sure the lap was completely shut down in order to prevent the problem. The MAJOR advantage of Linux in this regard *might* be that the employer could make sure that hibernation were not supported on the companies laptops. This could likely be enforced using the Linux "kiosk" feature that allows a company admin to "lock down" features and access. But perhaps MS offers similar features through their administrator level. I don't know enough about Windows as to whether they can lock a user out of the hibernation feature.
