Read the Appeals Court opinion?
The Judges hinted the settlement that they were most likely to approve, and the Justice Department knew that if more were obtained further appeals would leave them with nothing for years. With possible remand back to another trial Court.

One advantage of settling was that something at least went into effect. How would you feel if the Microsoft penalties were approximately the same as those in the settlement, but were going into effect now?

I think the Justice Department was pragmatic and did obtain some real changes in how Microsoft does business. You might not think that was enough, but what they obtained was approximately what they could get.
