1) Accusing Apple directly (e.g. by letter or telephone) would be futile. Most likely they would simply ignore the complaint. Accusing them publically, as has been done, is demonstrably much more effective.

2) "Filing a lawsuit" is not "accusing". It is "suing".

3) Only an injured party (or his agent) can file a lawsuit. Thus, only someone who purchased (or was otherwise damaged by) one of the defective Ipod units would have any cause of action. We can assume that the accuser(s) do not belong to this class.

4) I, too, find it more than a bit suspicious that an Apple product contains a "Windows" virus or worm, and consider it very likely that this was indeed a deliberate stunt. But from the press release, it appears they are pushing Symantec and McAfee "anti-virus" products, not Macintosh OS.
