Open != Open Source
Publishing source code does not make it Open Source, but it does make it open. You are free to study any patent registered at the Patent Office, they too are published.

Being tainted by looking at patents is only an issue if you intend to create a similar product or item. Any potential competitor of VoteHere can simply not view the code. If they want to know what's in it, they can ask an independent 3rd party to provide a pr?cis, or to remove any patented material before giving it to VoteHere.

Also, VoteHere would have to prove that the competitor viewed their code and copied ideas from it, usually only possible if the competitor also publishes there code.

Finally, I'd imagine that the market for voting software is limited to just a few customers, so it's unlikely that a plethora of competitors will eventuate anyway.

The ideas behind patents are often revealed simply by using a product, I don't see that publishing the source online either threatens the patent holder or compromises those who would make competing products.
