Are hackers off the hook now?
This will backfire when prosecuters want to go after hackers. In past cases the defense has often maintained that no harm was done and many individuals were prosecuted anyway on the unsubstantiated damage claims. I'm sure there are a few convicted hackers that wish this precedent had been available to them.
