Something is not quite right here
I am confused

Do not know much about law, but what does the fact that the info "has not been misused" have to do with
the lawsuit against the company?
If it gets "misused" 5 years from now, then people can sue? How can you prove 10 years from now where the "misusers" got it from.
I thought it was for failing to protect the data.
