Actually, just reading their eMail probably would have been the correct legal option. The whole reason for the SOX eMail retention guidelines is to allow going through an employee's eMail during an investigation. They would just need to log that an investigation was conducted, what was done, what messages were read, etc. Also, remember that under SOX, there are many areas, such as eMail, where you can "do what you want". SOX penalties are generally only monetary, and I know of companies that don't archive eMail, because the cost of retention is far greater than the cost of what they would pay if they were ever fined for not following the retension provisions. They could have read their eMail messages, and if it was deemed a SOX violation, just pay the fine.
