Don't Be So Sure
You should read California's Anti-Spyware law first. It's loose enough to leave interesting loopholes like this. Also, look up the definition of hacker, and compare to the actions taken by HP. Then consider that hacking is illegal under the USA PATRIOT Act. California's AG has plenty of room to act. It is an election year after all.
