The CRIA will have great difficulty base on the way Canadian copyright laws are. Here in Canada the copyright law states that you HAVE to copy the song or what ever to be considered copyright infringement. So making it available means you aren't copying. This is the main differnce between US and Canadian copyright laws. In the US you can go after those distributing while in Canada you go after those doing the copying.
Before this all happen a few lawyers wrote an article on this explain exactly why law suits like the US has going on will not work in Canada.
Also I think the judges here have realized that the music business on whole is doing very well in Canada in spite of file swapping.
