It is a privelage to *drive* an automobile, and your logic does hold true that it would be a privelage to *fly* an airplane.

In the US, there is also a protection against unreasonable search and siezure. The courts have upheld that patrolling an area does not constitute searching, although applying the term "patrol" to this kind of a program would be a stretch.

I agree that there are some privacy issues to work out, but I'd side with the governments on this one. If I were a dissident from a repressive regime, I wouldn't be travelling on a passport issued that that country!
