Those statements I have no problem with.

But then you said, that this situation "...is similar in that the private citizen (homeless man) discovered evidence of a crime (dead body) while committing a crime himself (trespassing).? This implied that UU1069 had made no pre-meditated attempt to gather evidence of a crime by method of committing one himself.

This is where your logic slips.

If you will recall the article, UU1069 deliberately placed the Sub7 on the alt.binaries.pictures.erotica.pre-teen newsgroup.

This strikes me as :

1) a deliberated attempt to gain access to computers illegally
2) targeted specifically at individuals with a taste for child pornography.

Using those 2 criteria we can then only assume that this ?private citizen? committed a crime with the intent of finding evidence of a previously committed crime.

Given the information in the article and your own statements Steiger should be given another trial.

Now, if UU1069 also placed the trojan on other unrelated groups that might give some credence to relaxing this a bit.

I?ll post other comments on other facets of this case. (in case anyone cares..hehe.)
