And that is the unknown, which could validate/invalidate my statement or yours. We don't know where else this guy planted this trojan, or what his motive was in planting it.

Now if he planted it with the explicit purpose of uncovering evidence of another crime and turning people in, then yes, I agree, the defendant in this case should be given a new trial, or released since there's no way really to support a conviction without what the hacker found.

Did he plant it on other newsgroups/web sites? We don't know. Was his intent on tracking down child pornographers or those seeking child pornography? Again, we don't know.

And the only way to determine what his motive was is to interview the hacker, preferably in open court as it is this one unknown that balances the legality of the evidence.
