Why do you want a custodial sentance? For punishment? What good will it do? Pretty much all the evidence points to the fact that if put such people into the prison system for such a crime the chance of them learning NEW criminal behaviours, meeting people and becoming part of the criminal community & so re-offending is very high. Not to mention certain people (not you I'm sure) won't give an ex-con a break even when they have done their time and paid their debt and are trying to rejoin the law abiding community.

This kid is in employment and paying taxes, and buying services which give others jobs. He also is going to college where he might get a better job and pay more back into the community. This was a prank... yes it could have had concequences but any hospital that can be "taken down" (by which I think you mean critical healthcare systems affected) by an email spamming needs to hire some proper IT professionals.

This kid has a curfew and if its broken then futher action can be taken.

I think the risk/reward to society is clear here and the judicial system is working if it stops a re-offence and doesn't burden tax payers more than it needs to AND teaches the kid a lesson while allowing him to grow up and become a contributing member of society.

We don't need to punish people for them to learn a lesson - and every person in prison is a non contributing member of society and a burden on the tax payers. Some people I agree just won't get the message and those are the people that need locking up but jeez - give the kid a break!

I'd say the risk/reward balance was got about right in this case.
