The main problem
The main problem with your post is that:
1. It must be proven that the room existed as alledged.
2. That it was in fact used by the NSA.
3. That if the room existed and it was used by the NSA, that it was used to spy on domestic calls and traffic rather than international traffic.
4. That the part of the law cited by ZDNet was in fact the part used.
5. That it was a contract (as you stated) instead of a legal requirement. This will be the hardest as while the NSA might have paid for expenses incurred complying with the request, that does not become a contract, as defined by law, between NSA and AT&T.

5. and the major one, that whatever, if anything, that was done, in fact broke any federal law.
